1. Acceptance of Terms

By accessing or using YaarGhar ("the Platform"), operated by YaarGhar Technologies Pvt Ltd, you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree, please do not use the Platform.

We may update these Terms from time to time. Material changes will be notified via email or in-app banner. Continued use after changes constitutes acceptance of the revised Terms. The "Last updated" date reflects the latest revision.

2. Definitions

• "Platform" — The YaarGhar website (www.yaarghar.com), mobile applications, and APIs
• "User" — Any person who accesses or uses the Platform
• "Owner" — A User who lists a property for rent, sale, or new project
• "Seeker" — A User who searches for properties on the Platform
• "Listing" — A property advertisement posted by an Owner on the Platform
• "Subscription" — Paid plan for Seekers to access premium features (unlimited chats, etc.)
• "Content" — All text, images, data, and materials on the Platform

3. Eligibility

You must be at least 18 years old and legally capable of entering into contracts under Indian law to use the Platform. By using the Platform, you represent and warrant that you meet these requirements. Users under 18 are not permitted to create accounts or use the Platform.

4. Account Registration

• Accounts are created via OTP verification on a valid Indian mobile number (+91)
• You are responsible for maintaining the confidentiality of your account and device
• You must provide accurate, current, and complete information during registration
• One account per person; duplicate accounts may be suspended or terminated
• We reserve the right to refuse, suspend, or terminate accounts at our discretion
• You must notify us immediately of any unauthorized use of your account

5. Owner Responsibilities

By posting a Listing, you represent, warrant, and agree that:

• You are the legal owner, co-owner, or authorized representative of the property
• All information in the Listing is true, accurate, complete, and current
• You have the legal right to rent, sell, or advertise the property on the stated terms
• The property complies with all applicable laws, regulations, and housing society rules
• Photos are of the actual property (not stock, staged, or misleading images)
• You will not discriminate against any protected class under Indian law
• You will respond promptly and honestly to genuine inquiries
• You will update or remove the Listing promptly when the property is no longer available

Listing is 100% free for Owners — forever. No listing fees, no brokerage commission, no hidden charges. YaarGhar does not charge owners for posting, editing, or managing listings.

6. Seeker Responsibilities

• Use the Platform only for genuine property search (rent, buy, or new projects)
• Communicate respectfully and honestly with Owners via in-app chat
• Do not spam, harass, make fraudulent inquiries, or waste owners' time
• Verify property details, legal status, and physical condition independently before any transaction
• Report suspicious, fraudulent, or misleading listings using the Report feature
• Do not bypass the Platform to avoid subscription (circumvention is prohibited)

7. Verification & Trust

• Owner verification (Aadhaar/PAN) is voluntary but encouraged for trust-building
• Verified badge indicates document verification only — it does not guarantee property condition, legal title, or transaction success
• We do not guarantee the accuracy, completeness, or reliability of any Listing
• Users must exercise due diligence before any rental, purchase, or financial commitment
• YaarGhar is not a party to any transaction between Owner and Seeker

8. Subscription Terms (Seekers)

• Premium subscription provides unlimited chats and priority features for 90 days
• Free trial available for eligible new users (duration and eligibility subject to change)
• Payment is processed via our payment gateway partner (Razorpay / PayU)
• No automatic renewal — subscription expires after 90 days unless manually renewed
• Subscription is personal and non-transferable
• Refunds governed by our Refund Policy (/refund)
• We reserve the right to modify subscription features, pricing, or trial terms with notice

9. Prohibited Activities

You agree NOT to:

• Post fake, misleading, duplicate, or fraudulent listings
• Impersonate another person, entity, or misrepresent your affiliation
• Scrape, crawl, spider, or extract data from the Platform without written permission
• Use automated tools, bots, or scripts to access or interact with the Platform
• Transmit viruses, malware, ransomware, or any harmful code
• Interfere with Platform security, performance, or integrity
• Reverse engineer, decompile, or attempt to derive source code
• Use the Platform for illegal activities under Indian law
• Harass, threaten, stalk, or discriminate against other users
• Collect or store personal data of other users without consent
• Post content that infringes intellectual property rights

10. Intellectual Property

All Platform Content (excluding User Content) — including trademarks, logos, brand assets, design, code, databases, and "YaarGhar" name — is owned by YaarGhar Technologies Pvt Ltd and protected by Indian and international intellectual property laws.

By posting a Listing or any User Content, you grant YaarGhar a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, sublicensable license to use, display, reproduce, modify, distribute, and promote your Content on the Platform and in our marketing channels (with attribution where feasible). You represent you have all necessary rights to grant this license.

11. Disclaimers

• No Brokerage: YaarGhar is not a real estate broker, agent, or intermediary. We provide a technology platform only. No fiduciary relationship is created.
• No Guarantee: We do not guarantee property availability, condition, pricing accuracy, legal title, transaction success, or user behavior.
• As-Is: The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• Third-Party Links: We are not responsible for external sites linked from the Platform.
• Uptime: We strive for high availability but do not guarantee uninterrupted or error-free access.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• YaarGhar shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages
• Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim (or ₹1,000 if no payments were made)
• We are not liable for any property transaction disputes, agreements, or losses between Users
• We are not liable for any User Content, third-party actions, or force majeure events

Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum extent permitted.

13. Indemnification

You agree to indemnify, defend, and hold harmless YaarGhar Technologies Pvt Ltd, its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Platform, (b) your violation of these Terms, (c) your User Content, (d) your violation of any third-party rights, or (e) any property transaction you engage in via the Platform.

14. Termination

• We may suspend or terminate your account and access to the Platform for violating these Terms, with or without prior notice
• You may delete your account at any time via the app settings or by contacting support
• Upon termination, your license to use the Platform ends immediately
• Provisions that by nature should survive (IP, liability, indemnification, governing law) survive termination
• We may retain certain data post-termination as required by law or for legitimate business purposes

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Platform shall be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bangalore, Karnataka, and the language of proceedings in English.

Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction.

16. General

• Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and YaarGhar.
• Severability: If any provision is found unenforceable, the remainder continues in full force.
• No Waiver: Failure to enforce any right does not waive that right.
• Assignment: You may not assign these Terms. We may assign them freely.
• Force Majeure: We are not liable for delays due to events beyond our reasonable control.
